GratisEvo Terms of Service & Privacy Policy
Welcome to GratisEvo.
These Terms of Service and Privacy Policy (“Agreement”) govern your use of the GratisEvo platform, website, mobile experience, and related services (collectively, the “Service”). By creating an account, using the Service, or logging in, you agree that you have read, understood, and accepted this Agreement.
1. About the Platform
GratisEvo is a platform for connecting project owners seeking help with defined project work and contributors who want practical experience building skills through scoped contributions. The Service is designed around small, clearly defined contributions rather than traditional employment, freelance contracting, or open-ended labor arrangements.
A contribution is intended to be bounded, clearly scoped, limited in duration, tied to a concrete deliverable, and appropriate for short-term or project-based participation.
GratisEvo is not a traditional freelance marketplace, employment agency, employer, payroll or benefits provider, contractor management service, or a guarantee of work, matching, completion, or success.
2. Platform Model and User Relationship
Users are independent actors. The platform does not create an employment relationship, agency relationship, contractor relationship, co-employment relationship, or any other legal employment arrangement between the platform operator and any user.
Project owners and contributors are responsible for choosing whether a contribution is appropriate, agreeing to scope and expectations, communicating clearly, deciding whether to participate, and managing their own work, time, and obligations.
The platform operator does not act as an employer, contractor manager, recruiter, legal advisor, mediator for all disputes, or guarantor of user outcomes.
3. No Guarantee of Work or Outcomes
The platform does not guarantee that any project owner will post work, any contributor will receive opportunities, any contribution will be completed, or any user will gain employment, internships, offers, partnerships, or other outcomes. Participation is voluntary and may be discontinued at any time, subject to reasonable communication and project expectations.
4. Scope of Contributions
Contributions should be realistic in size, clearly defined, limited in scope, aligned with the stated skills, time, and duration, and connected to a specific deliverable. Users must not treat a contribution as open-ended unpaid labor or a substitute for full-time employment. Broad, vague, or unbounded work should be broken into smaller tasks before being listed or accepted.
Project owners must provide accurate information about the task, expected time, expected duration, deliverable, required skills, difficulty, pressure level, and what the contributor receives in return. Contributors must assess the suitability of a contribution before accepting it.
5. User Responsibilities
Users agree to provide accurate profile information, not impersonate another person, communicate respectfully and in good faith, not abuse or exploit other users, and not engage in harassment, discrimination, threats, spam, fraud, or deceptive behavior. They must not present false claims about skills, credentials, experience, work completed, or project ownership. Users are personally responsible for the content they publish, the work they submit, the claims they make about their skills, projects, and outcomes, and any personal or professional consequences that arise from their participation.
6. Ownership of User-Generated Content
Except for personal information processed by the platform in connection with account operations and service functionality, all content created, posted, uploaded, submitted, or otherwise made available by users through the Service is user-generated content. This includes project descriptions, contribution descriptions, files, documents, designs, code, images, media, feedback, reviews, comments, messages, profile information, recommendations, endorsements, references, and project updates.
The platform operator does not create, verify, validate, guarantee, or assume legal responsibility for the accuracy, completeness, usefulness, quality, origin, legality, intellectual property status, or business value of user-generated content. Users retain ownership of their own content, subject to any separate agreement between the user and another party, unless otherwise stated.
Project owners retain ownership of their project materials, concept materials, proprietary information, and other assets they own, unless they expressly agree otherwise. If a contributor creates work for a project, ownership of that work is subject to any explicit agreement between the parties and to the terms of the project or contribution listing. The platform does not act as a legal owner or arbiter of such ownership disputes.
7. Intellectual Property and Third-Party Rights
Users must not upload, share, or present content they do not have the legal right to use, including copyrighted material, trademarks, third-party designs, protected media, confidential materials, personal information belonging to others, or content that infringes the rights of another party. The platform may review content and remove or restrict material that violates applicable law or platform policy, but does not guarantee that all content is reviewed before publication and does not assume responsibility for its legality or appropriateness. Users are solely responsible for respecting third-party rights and obtaining any necessary permissions.
8. Verification, Reputation, and Project Credit
The Service may allow users to create verified contribution records, review histories, project credit, and reputation signals based on activity and confirmation from users. Verification and reputation features are designed to help show work and progress. They are not professional certification, legal validation, or guarantees of skill, commercial value, or future outcomes. Users may not falsely represent project completion, participation, skill level, hours worked, credit received, verification status, or ownership of work. The platform may review or remove reputation-related content if it appears misleading, fraudulent, abusive, or in violation of policy.
9. Disputes Between Users
The platform is not a legal intermediary for all disputes between users. Users are responsible for setting scope, agreeing on expectations, communicating clearly, resolving disagreements directly, and making their own decisions about engagement. The platform may moderate serious issues, review reports, or restrict access when necessary, but does not guarantee dispute resolution or any particular outcome. The platform shall not be liable for disputes between project owners and contributors, disagreements over work quality, scope, deadlines, or interpretation, or losses caused by project decisions, expectations, or user conduct.
10. Data Privacy and Personal Information
The platform collects and processes personal information necessary to operate the Service, including account information, profile information, email address, login credentials and security data, project and contribution data, communication data, activity records, device and technical metadata, and moderation records. This data is used to create and manage accounts, support matching and project discovery, maintain platform integrity and safety, deliver notifications, enforce terms and moderation standards, and improve the Service. The platform will handle personal data in accordance with this Privacy Policy and applicable law.
11. Public vs Private Data
Some data may be visible publicly, including public profile fields, public project descriptions, public contribution listings, public portfolio or work samples where permitted, and public activity or reputation information. Other information may be private, including account login information, private messages or internal communications, private project data, confidential user data, and support or moderation records. Users are responsible for deciding what they share publicly. Public information may be visible to others, including users, partners, and third parties with access to the Service.
12. Privacy: Personal Information Protection
The platform will use reasonable technical and organizational safeguards to protect personal information. However, no system is completely secure, and no method of transmission or storage is completely risk-free. The platform does not guarantee that unauthorized access, loss, disclosure, or misuse will never occur. Users are responsible for maintaining the confidentiality of their login information, using strong passwords, notifying the platform promptly if their account is compromised, and protecting their own accounts and devices.
13. Cookies, Analytics, and Tracking
The Service may use cookies, session data, and similar technologies to keep users logged in, remember preferences, support security, analyze usage, and improve product functionality. The platform may also use third-party services for analytics, email delivery, hosting, or related operational functions. Users may manage browser settings to limit cookies, but some features may not function properly if cookies are disabled.
14. Data Retention
The platform may retain personal data for as long as necessary to provide the Service, maintain account access, enforce the Agreement, resolve disputes, support moderation and safety, comply with applicable law, and maintain records required for legal or operational reasons. When personal data is no longer needed, the platform may delete or anonymize it, subject to legal and operational requirements.
15. User Rights
Depending on applicable law, users may have rights to access their personal data, correct inaccurate data, request deletion of personal data, restrict or object to certain processing, export their personal data, or withdraw consent where applicable. Users may contact the platform to request information about their data or to exercise these rights where supported by applicable law.
16. Third-Party Services
The platform may use third-party service providers for hosting, email delivery, data storage, analytics, infrastructure, security, and support tools. These providers may process personal information on the platform’s behalf. The platform is not responsible for the privacy practices of third-party services beyond reasonable due diligence and service configuration.
17. Minors and Age Restrictions
The Service is intended for adults and users who are legally eligible to use it under applicable law. Users must not use the Service if they are under the minimum age required by law to consent to the processing of personal data or to use online services. Parents or guardians are responsible for supervising minors and ensuring that minors do not share information or content inappropriately.
18. Moderation and Enforcement
The platform may review, restrict, remove, or disable profiles, projects, contributions, content, reports, accounts, notifications, or access to features. The platform may take such action for reasons including policy violations, abusive conduct, fraud, misinformation, harassment, legal risk, operational concerns, or security concerns. Moderation decisions are made at the platform operator’s discretion and are not legal determinations.
19. Account Suspension, Termination, and Restrictions
The platform may suspend or terminate a user account if the user violates this Agreement, engages in abusive or unsafe behavior, provides false or harmful information, breaches applicable law, or if continued access would be unsafe or inappropriate. Users may lose access to features, content, or accounts if they violate policy or present risk to other users or the platform.
20. No Warranty and Limitation of Liability
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, the platform does not guarantee uninterrupted, secure, or error-free service, any project outcome, match, contract, result, or benefit, or the accuracy, legality, quality, originality, or usefulness of user-generated content. The platform is not liable for indirect, incidental, consequential, special, punitive, or similar damages, or for losses arising from user disputes, user conduct, project outcomes, content, or external arrangements. The platform operator is not responsible for lost time, lost opportunity, reputational damage, professional consequences, project failure, business losses, or harm caused by user-generated content or user interactions. Except to the extent required by applicable law, the platform operator shall not be liable for user-created content, project data, contribution outcomes, or the consequences of user-to-user relationships.
21. Platform Non-Liability for User-Created Content
Except for the platform’s own personal data processing and internal operational records, all user-created content, project material, contribution descriptions, work products, project reviews, recommendations, comments, messages, feedback, reputation records, and other content or statements made by users are created by the users themselves and are not the legal responsibility of the platform owner. The platform operator does not assume legal responsibility for the content created by users, the truth or accuracy of user statements, the quality, completeness, or legality of user-created work, project descriptions, claims, deliverables, or outcomes, or any dispute arising from user-made content or project work. The platform is not responsible for legal consequences arising from user-generated content, project materials, work product, or user interactions, except to the extent required by applicable law or where the platform itself has directly caused harm through its own unlawful conduct or negligence.
22. Security and Risk Notice
Users should exercise caution when sharing personal information, portfolio information, contact details, project materials, confidential work, or sensitive ideas. The platform cannot guarantee that all information shared in connection with the Service will remain private or secure. Users are solely responsible for deciding what to share and with whom.
23. Changes to This Agreement
The platform may update this Agreement from time to time. Continued use of the Service after such changes means that the user accepts the updated terms. Where materially changed, the platform may require renewed acknowledgment before continued access.
